1. Acceptance of Terms

Through your access, download, or usage of the BharatiyaGPT website, mobile app, or any related services, you consent to the binding nature of these Terms and Conditions ('Terms'). In case you do not agree with these Terms, we kindly request that you not use the Services.

2. Intermediary Status and Compliance

BharatiyaGPT operates as an intermediary platform under Section 79 of the Information Technology Act, 2000. Immverse AI complies with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and applicable amendments. Users acknowledge that Immverse AI does not initiate, select, modify or control user inputs and generated outputs beyond automated system processing, and shall not be liable for unlawful user conduct except to the extent required under applicable law and statutory compliance obligations.

3. Eligibility

To avail the services, your age must be at least 18+ years or the age of majority in your area. While using BharatiyaGPT, you are representing and warranting yourself to have the legal capacity to enter into this agreement.

4. Nature and Purpose of the Platform

BharatiyaGPT is a platform of information, education, and research. The application content comes from AI models trained on a careful selection of datasets from Indian manuscripts, classical texts, translations, scholarly interpretations, and publicly available research.

The information given:

This platform is meant to be for general knowledge and educational purposes. Users should not depend on the information provided by the Platform to be the only source of information for important or professional decisions.

Users must independently verify the information provided before making any sort of important or professional decisions based on that information.

Intellectual Exploration: In creating responses, the Platform relies on the use of Artificial Intelligence models that utilize data from the combined knowledge bases of historical data, cultural context, and the Indic knowledge. Outputs may vary and are not guaranteed to reflect definitive scholarly consensus.

5. Your Responsibilities

5.1 Creation of Account and Information Accuracy

You are responsible for your access and use of the BharatiyaGPT Services, which are referred to in this Agreement as the "Services". For using some of the Services, you may be required to create an account with a unique username and password combination. You agree to provide current, complete, and accurate registration information about yourself and to keep such information updated.

5.2 Security of Accounts

You are fully responsible for maintaining the confidentiality and security of your identification and login credentials for access to the Services and your account, and fully responsible for all activities that occur under your login credentials or account, whether or not authorized by you. In the event of any unauthorized access or use of the Services, and/or any unauthorized use of your identification and login credentials for access to the Services or your account, or any other breach or threatened breach of the security of your account, notify Immverse AI, owner of BharatiyaGPT, immediately in writing at [email protected], and terminate the current credentials under which you access the Services, if Immverse AI has any reason to believe that there is likely to be a breach of security

5.3 Responsibility for Account Activity

You are responsible for all use and activity on your Account, regardless of whether conducted manually or automatically as a result of your negligence or permission. Keep your login information confidential and in accordance with applicable laws, such as data protection laws in India.

5.4 Prohibited Commercial and Automated Use

Unless expressly permitted under a paid subscription plan, enterprise license agreement, API access agreement, or separate written authorization issued by Immverse Innovations Private Limited, you shall not:

1. Use the Services or AI Outputs for commercial resale, monetization, or redistribution;
2. Use the Services for advertising, marketing, solicitation, or promotional activities;
3. Sublicense, resell, rent, lease, or provide access to the Services to any third party;
4. Use bots, scrapers, automated tools, or impersonated identities to access or extract platform data.

5.5 Content That May Not Be Found as Regards to the Following Sections

You agree to refrain from uploading, posting, transmitting, storing, or making content available that

1. Violates any Indian laws or regulations or any law or regulation of your jurisdiction;
2. Infringes the copyright, patent, trademark, trade secret, or other intellectual property rights of any third party;
3. You do not have a right to transmit the content by contract, law, or fiduciary duty;
4. Contains any viruses, malware, or other harmful code that disrupts the Service;
5. Is false, deceptive, or misleading;
6. Is defamatory or libellous, threatening, harassing, hateful, abusive, pornographic, obscene, or otherwise constitutes an offensive anti-social experience;
7. Advocates and encourages any form of discrimination, intolerance, bigotry, prejudice, racism, hatred, or harm;
8. Depicts any violent and threatening behaviour or activity;
9. Violates any right of privacy and publicity;
10. Impersonates any other person or misrepresents the identity of any other person;
11. Solicits any personal information or data from any minor;
12. Collects personal information or data about others without their permission;
13. Includes any unsolicited advertising or promotional materials;
14. Links to any website that provides access to hacking, gambling, pyramid schemes, and/or pirated materials;
15. Causes a disruption of the Company's servers, networks, or operations;
16. Knowingly or unknowingly attempts to gain unauthorized access to any of the Company's systems or accounts;
17. Is a user of automated programs (bots, scrapers) or automated tools to post or retrieve information from the Company;
18. Modifies, disables, or circumvents the Company's security features;
19. Modifies metadata to hide the real origins;
20. Affects the United States Government, its agencies and the citizens thereof (local and State) by affecting their ability to use the Company's services; and
21. Violates the Company's Acceptable Use Policy, Privacy Policy, Terms of Service, or other Company guidelines.

5.6 Compliance with and Consequences of Prohibited Conduct

All prohibited actions must immediately cease when directed by Immverse AI. Failure to comply may result in the immediate suspension or termination of access to and/or licence for the Services. The suspension or termination will be without notice and without liability for any damages to Immverse AI related to the suspension or termination.

6. Intellectual Property Rights

The whole content at BharatiyaGPT is contained in or includes, but is not limited to, the following:

• Written language, computer-assisted responses, explanations, and abstracts.
• Software, algorithms, models, and code.
• Logos, trademarks, designs, and branding

These are the sole property of Immverse Innovations Private Limited and its licensors unless otherwise indicated.

The platform composes, organizes, and showcases knowledge from ancient sources; nevertheless, the compilation, AI-powered structuring, presentation, and technological infrastructure are proprietary.

You are prohibited from:

• The user must obtain the content through any available method, then proceed to create copies that they will sell for profit.
• The user must create copies of the original material.
• Seek competing AI systems' training with the content without written consent.

7. User Responsibilities

• The law allows users to access and use the App only if they do so without violating intellectual property and privacy rights or if they do not harm the App by transmitting malicious content like viruses. In addition, do not reverse-engineer the App, scrape it, or overload it by continuous use.​
• Although the inputs are yours, we have a license to use them for the purpose of service improvement, response generation, and compliance.
• Output is for your information; checking its accuracy through your own means is suggested.​
• It is prohibited to do the following: to exploit the App commercially without permission, to spam, or to use the App for illegal activities.​

8. Privacy and Data Protection

• You must comply with our Privacy Policy rules when you use the Services. The policy explains our process of collecting your information and our methods of using and protecting your data.
• The Privacy Policy also describes our information-sharing practices with third parties.
• If you use the Platform, that means you agree with how we handle your information, as it is written in the Privacy Policy.
• Immverse AI processes personal data in accordance with the Digital Personal Data Protection Act, 2023, and applicable data protection regulations in India.

• Users consent to lawful collection, processing, storage, and usage of personal data strictly for platform operation, security compliance, service improvement, and regulatory obligations as described in the Privacy Policy.

9. Accuracy and Limitations of AI Responses

The AI, BharatiyaGPT, intends to give accurate information and also be authentic in terms of culture. However, the outputs of AI are generated:

• Sometimes wrong, incomplete, or not adequately interpreted.
• Relying on historical records that might refer to several schools of thought.
• Showing scholarly reconstructions rather than legitimate conclusions.

BharatiyaGPT does not promise that any of the output will be complete, dependable, or accurate.

10. Third-Party Links and References

There may be links or references to third-party websites, texts, or resources on the platform to provide additional context. BharatiyaGPT has no control over and is not liable for the content, accuracy, or practices of any third-party services.

11. AI Output Licensing and Ownership Structure

AI-generated outputs are licensed to users on a limited, non-exclusive, non-transferable, revocable basis strictly for personal, educational, and internal research use, unless expressly permitted otherwise by Immverse Innovations Private Limited in writing.

All platform architecture, AI models, training methodologies, dataset structuring, system compilation, interface design, and proprietary processing workflows remain the exclusive intellectual property of Immverse Innovations Private Limited.

Nothing in these Terms grants users ownership rights over platform-level intellectual property.

12. Generative Media and AI Outputs

• AI-Generated Content: The Services create text and other things like explanations and summaries using intelligence. This artificial intelligence makes these things from what the user types in and from Indian knowledge sources. The Services use intelligence to make these things, which are called AI Outputs.
• No Human Authorship or Authority Claim: The things that Artificial Intelligence systems write are not written by any person, like a Rishi, a scholar, or a human expert. So you must not say that Artificial Intelligence outputs are certified research or professional advice from an expert. Artificial Intelligence outputs are also not the authority on any subject. They are just what Artificial Intelligence systems come up with. Artificial Intelligence outputs must not be considered as the authority on anything.
• Permitted Use of Artificial Intelligence Outputs: You can use Artificial Intelligence Outputs for your personal use, for educational purposes, or for research inside your organization. If you want to use Artificial Intelligence Outputs for business or sell them, share them with others, or make money from Artificial Intelligence Outputs, you need to get permission in writing from Immverse AI (owner of BharatiyaGPT).
• Accuracy Disclaimer: Due to the interpretive nature of historical sources and generative models, AI Outputs may contain errors, omissions, or differing viewpoints. BharatiyaGPT does not guarantee accuracy or completeness.

13. Ownership and Copyrights

• Platform Ownership: Immverse AI (as owner of BharatiyaGPT) or its licensors own the entire services, all rights, titles, and interests, including AI models, software, graphics, structure, branding, and proprietary compilations.
• Immverse AI and other companies having relationships with it own all the trademarks, logos, service marks, and trade names, whether registered or unregistered, shown in the Services. Immverse AI’s prior written consent is required to use such marks in any way. Immverse AI’s rights in the area of intellectual property will always be immovable and thus remain with Immverse AI only.
• If imputed through the Services, you may directly report copyright infringement or violation to Immverse AI as laid down by Immverse AI’s Copyright Policy while at the same time enjoying the protection of the corresponding rights. If a counter notice is received, Immverse AI may restore the content that was removed after a valid counter notice is sent by you.

14. Confidentiality

You agree not to disclose any non-public confidential technical or business information of Immverse Innovations Private Limited that is expressly designated as confidential or made available to you through privileged platform access. Confidential Information shall consist of the following, but not limited to:

1. The source code of the Services, technology, unpublished documents, and technical information that is not public.
2. Immverse AI business or technical plans, strategies, methods, and projections.
3. Immverse AI research and development, prototypes, software, or hardware products/services not commercially released yet.

Legal Notice: Such disclosure of confidential information shall be permitted only when so required by law or the order of the authorities.

15. Feedback

Voluntary Feedback: You are welcome to submit any suggestions, ideas, improvements, or feedback you might have without any expectation of compensation.

Rights in Feedback: You hereby grant Immverse AI (owner of BharatiyaGPT) the right to use, adapt, incorporate, and commercialize such Feedback worldwide on a perpetual, irrevocable, and royalty-free basis.

16. Disclaimer

The Website, Mobile Application and the associated Services, and all the features, tools, Content, and AI-Output services whether provided by Immverse AI or third parties on our behalf collectively, "Services" are provided to you "as is" and "as available" basis, without warranties or representations of any kind, express, or implied, from Immverse AI.

The Services provided by Immverse AI are not supported by any guarantee made by the company regarding their availability, reliability, accurate performance, complete performance, or suitability for specific uses.

17. Warranties

To the maximum extent permitted under applicable law, Immverse Innovations Private Limited expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement, uninterrupted service, system availability, error-free operation, and data integrity. The Services and AI-generated outputs are provided strictly on an "as-is" and "as-available" basis.

18. AI-Generated Content Disclaimer

BharatiyaGPT utilizes generative artificial intelligence that is based on a curated dataset of information sourced from Indic Manuscripts, Classical Texts, Translations, Interpretations, and Academic Research.

1. AI-generated responses: AI-generated responses are algorithmically created, so they can differ across users depending on what they enter into the system.
2. AI-generated responses may contain errors, omissions, or different interpretations of the same fact or circumstance.
3. AI-generated responses are intended to provide information and to serve as educational material. They do not represent final answers or definitive results. Neither the AI’s output should be used as an alternative for professional advice nor should it be viewed as a permanent, absolute truth.

19. Indemnity

You agree to indemnify, defend, and hold harmless Immverse AI, its directors, officers, employees, agents, and affiliates against any claims, losses, damages, liabilities, penalties, costs, or expenses arising from:

1. Your violation of these Terms;
2. Misuse of AI Outputs;
3. Intellectual property infringement;
4. Violation of law or third-party rights;
5. Unauthorized commercial use of the Services.

20. Governing Law and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of India without regard to its conflicts of laws. All disputes related to these Terms will be resolved by the courts in Nagpur, India.

You acknowledge and agree that the Courts at Nagpur, Maharashtra, shall have exclusive jurisdiction for interim reliefs, injunctive actions, intellectual property enforcement, and statutory remedies, subject to the arbitration clause contained herein.

21. Limitation of Liability of BharatiyaGPT

No Reliance Liability: Immverse AI will not bear liability for the consequences of any decision or action that was taken based on AI output or the content of the platform.

Exclusion of Damages: Immverse AI will not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill, to the maximum extent permitted by law.

Liability Cap: In cases where liability cannot be eliminated, Immverse AI’s overall liability shall not be greater than the amount paid by you, if any, for the Services during the previous twelve (12) months. Nothing in this clause shall limit liability where such limitation is prohibited under applicable law.

22. Termination

Immverse AI / BharatiyaGPT reserves the right to suspend, restrict, or terminate access to the Services with or without notice in the event of:

1. Violation of these Terms;
2. Abuse or misuse of the platform;
3. Legal or regulatory requirements;
4. Security threats or operational risk.

Upon termination, access rights shall immediately cease, and no liability shall arise against Immverse AI / BharatiyaGPT for suspension or termination of Services.

23. Changes to Terms

The Terms may be changed or updated by us occasionally. If you continue to use the Services after changes, it means you accept the new Terms.

24. Subscription and Payments (Hold for Now)

Some content or features may be available only under paid subscriptions. The following terms apply to all fees:

• They are pointed out clearly at the time of purchase.
• They are non-refundable except in cases mandated by law.
• They can be changed, but with prior notice.
• Access may be suspended or terminated due to non-payment.

25. Grievance Redressal Mechanism

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and applicable data protection regulations, Immverse Innovations Private Limited has appointed a Grievance Officer for addressing user complaints and concerns. This mechanism is established in compliance with Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Users may submit complaints, grievances, or notices regarding:

1. Platform misuse or abuse;
2. Content-related concerns;
3. Privacy or data protection issues;
4. Intellectual property infringement;
5. Unauthorized access or security concerns;
6. Any violation of these Terms.

Acknowledgement of grievances shall be provided within twenty-four (24) hours, and resolution shall be completed within fifteen (15) days from the date of receipt, in accordance with applicable law.

26. Agreement to Arbitrate

You agree that any dispute, controversy, or claim arising out of or relating to these Terms, the Website, the Services, any transaction, interaction, or legal relationship between you and Immverse Innovations Private Limited (including any alleged breach thereof) shall be resolved exclusively by final and binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 and amendments thereto. By accepting these Terms, both parties expressly waive the right to initiate or participate in any civil suit, trial by jury, or class action proceedings, except as expressly permitted under applicable law.

Seat and Venue of Arbitration

The seat and legal place of arbitration shall be Nagpur, Maharashtra, India. The arbitration proceedings may be conducted physically or through virtual/online mode at the discretion of Immverse Innovations Private Limited.

Governing Law

This Arbitration Agreement shall be governed by and construed in accordance with the laws of India.

Appointment of Arbitrator

The arbitration shall be conducted by a sole arbitrator appointed by Immverse AI. In the event of disagreement regarding appointment, the arbitrator shall be appointed in accordance with Section 11 of the Arbitration and Conciliation Act, 1996.

Language of Proceedings

The arbitration proceedings shall be conducted in the English language.

Costs and Fees

Each party shall bear its own legal costs. The arbitrator’s fees and arbitration administrative expenses shall be borne as determined by the arbitrator in the final award.

Prohibition of Class and Representative Actions

You and Immverse Innovations Private Limited agree that claims may be brought only on an individual basis. The arbitrator shall not have authority to consolidate claims, conduct class arbitration, or preside over representative proceedings.

Relief Limitation

The arbitrator may grant relief only to the extent necessary to resolve the individual dispute and shall not award relief affecting any third party or unrelated users.

Pre-Arbitration Dispute Resolution

Before initiating arbitration, the aggrieved party shall send a written Notice of Dispute by registered post or email describing the nature of the dispute and the relief sought.

If the dispute is not resolved within sixty (60) calendar days of receipt of such Notice, either party may initiate arbitration proceedings.

Interim and Injunctive Relief

Nothing in this clause shall prevent Immverse Innovations Private Limited from approaching courts of competent jurisdiction for interim relief, injunctive protection, intellectual property enforcement, data protection remedies, or urgent preventive relief.

Confidentiality of Proceedings

All arbitration proceedings, submissions, evidence, and awards shall be treated as confidential unless disclosure is required by law or regulatory authorities.
