The Privacy Policy constitutes a legally binding agreement between you (the "User", "you", "yourself") and Immverse Innovations Pvt Ltd ("Immverse AI"). These terms are effective when you accept the Terms of Service or use the services for the first time, and they will govern how we collect, process, and treat your data.

PLEASE READ THIS PRIVACY POLICY CAREFULLY - it directly impacts your legal rights and obligations. By accessing the Platform and using our Services, you affirm that you have read, understood, and expressly consent to this Privacy Policy. If you disagree with any provision, you must immediately cease using the Platform and Services.

By using our website/application, you agree that you have read and fully understand our Privacy Policy and related terms, and that you agree to allow us to use your personal information in accordance with the Privacy Policy and its terms.

All of the information we collect through our website/application will be:

• Fairly, transparently, and lawfully processed in order to provide the Services to you;
• Collected only for a specific and legitimate purpose;
• Restricted to the minimum necessary for the purpose for which it was collected;
• Available to you to review, update, or correct as necessary; and
• Retained only for a period of time necessary for the purpose for which it was collected or to comply with legal obligations.

The information we have about you is essential to the operation of the user-facing features of BharatiyaGPT’s AI-driven Indic Knowledge Interface. If you do not want to provide us with your personal information or wish to withdraw your consent, you may do so at any time, and we may restrict or terminate your access to Service(s) accordingly. The Company will not be liable for any damages caused by the disclosure of your information where the disclosure was required by law for legitimate purposes, or where the disclosure occurred without any act or omission of the Company that caused the additional loss.

1.1 DATA PRINCIPAL RIGHTS UNDER APPLICABLE LAW

In accordance with the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and other applicable laws, Users shall have the right to:

1. Access their Personal Data processed by BharatiyaGPT;
2. Request correction, completion, updating and erasure of their Personal Data;
3. Withdraw consent at any time, subject to legal and contractual restrictions;
4. Nominate another individual to exercise rights in the event of incapacity or death;
5. Lodge grievances with BharatiyaGPT and the Data Protection Board of India.

BharatiyaGPT shall implement appropriate mechanisms to enable Users to exercise the above rights in a lawful and efficient manner.

Users may exercise their rights by submitting a request to the Grievance Officer. Withdrawal of consent or deletion requests may result in limited or discontinued access to BharatiyaGPT Services.

2. Personal Information Collected by Us

2.1. "User Personal Information" refers to any information about a User (an individual person) that is linked to them directly or through other information; therefore, when combined with any other information, it allows us to identify that user within ImmverseAI (BharatiyaGPT & its related services).

i) Personal Data that You Provide on Your Own

Immverse Innovations Private Limited (the "BharatiyaGPT", "we", "our", "us"), the owner of BharatiyaGPT, will collect all Personal Data about You from your use of BharatiyaGPT or any services provided by BharatiyaGPT via the Platform(s) at https://bharatiyagpt.ai as well as through other Platforms.

• Account Registration: You must register for a BharatiyaGPT account by providing your name, email address, password, and age verification (you must be 18 years of age or older according to our Terms of Service).
• Information Submission: You can submit queries, prompts, file uploads, or provide feedback about our services so that we may generate AI responses from Indic sources. This includes prompts, queries, uploaded files, training inputs, and outputs generated by BharatiyaGPT in response to such inputs.
• Subscription Interest: You can indicate your interest in subscribing to our premium services.
• Participating in our Support Network: You may participate in our support network by interacting with us in a variety of ways, including completing a survey(s), attending an online event, or attending one of our webinars about ancient Indic knowledge.

ii) Payment Information

We will collect as little Payment Data as possible to process payments for premium Services. For example, we need to collect payment instrument information (e.g., Card Number, Expiry Date, and CVV) and Transaction Records. Payment Information will be processed by a Payment Gateway Third Party that is PCI-DSS (Payment Card Industry Data Security Standard) compliant (for example, Razorpay, Stripe). Immverse AI does not keep full card numbers after authorization.

iii) Social Media Login Registration

Users may register on the Immverse AI platform using existing social media account(s) with Google, Facebook, Twitter/X, and/or LinkedIn by entering their social media account credentials. If you choose this registration method, we will receive basic profile information from the respective platform(s) that you used to register (name, email, profile image, and ID Token). For detailed practices regarding how we handle Social Logins, please see Section 2.8 "How We Handle Your Social Logins".

iv) BharatiyaGPT™ Mobile Application Permissions

The BharatiyaGPT™ mobile applications (available on iOS and Android) require permission to access certain things on your device, including:

Device Access:

We may access the camera (to scan handle texts for conversion to storage-readable text), microphone (for voice commands in Sanskrit/Hindi), storage (for file uploads), SMS (for OTP verification), and contacts (for limited sharing features) with your explicit permission. You can withdraw the access at any time through device settings.

Information about Your Device:

This app may collect information about your device when you are using the app, like device ID, model, manufacturer, OS version, app version, screen resolution, battery level, and network type.

Notifications:

You’ll receive push notifications about your Account updates, Alerts for New Indic Content, and reminders about queries you submitted (you can use your device settings to opt out of these notifications).

You are responsible for keeping all of your Personal Data accurate, current, and complete. You must notify Us of any changes to Your Personal Data by sending an email to [email protected].

2.2 Technical Information

If you use the Platform via the web, mobile, or API, we may collect Technical Information about you using cookies, web beacons, pixels, and similar technologies; this data is automatically collected as you use the Platform.

Automatic Collection During Use

Log Data: Server logs automatically collect the following data through IP address (or Proxy), Browser Type/Version/Settings, User-Agent String, Referrer URL, Timestamping, Session ID, Requested URL, Search Queries, Response Time, Error Codes, and Crash Reports.

Usage Data: Features of the Platform that were accessed (e.g., Rishi Q&A, Text Analysis), Content Categories of the Platform (e.g., Vedas, Upanishads, etc.), Duration of the Session and Depth of the Scroll, Click Patterns, Rates of Exit, and Country of Access as determined by your IP Address Geolocation.

Device Data:

Hardware model, OS/platform/version, installed fonts (for Indic script), available RAM / CPU, network carrier, connection speed (Wi-Fi / 4G / 5G), and screen orientation.

Information from this Device Data is used to establish the security of the Platform, help troubleshoot issues, and assist in providing internal analytics to optimize the services.

2.3 Non-Personal Information

Non-Personal Information is defined as any information collected about you that does not reveal exactly who you are, a user of BharatiyaGPT, and includes but is not limited to aggregated metrics from other users of the platform; browser type; Cookie data (see section 15), pixel/tag/web beacons; aggregate trends based on queries submitted by users of the platform and general statistics of usage activity.

(Separation of Personal Data, Technical Information, and Non-Personal Information is grouped together under the general term "Information.")

2.4 Ways in which BharatiyaGPT gathers users' Information

Information is gathered by multiple ways specific to BharatiyaGPT answering educational Artificial Intelligence requests from users:

• Account Registration - Name, email, age verification
• Domain Selection - What user selects, i.e., Forensics, Dermatology, Trigonometry, via the grid in the app
• Processing User Queries - Prompts submitted, text uploaded, vocal queries made (with consent)
• AI Interactions - How it was used and responses rated to responses provided by AI.
• Payment Processing - User transaction information via premium gateways.
• Mobile Permissions - Camera (scanning of manuscripts), microphone (input of Devanagari).
• Automatic Tracking - User session metrics during the exploration of Ayurveda and Vedas

2.5 Sources of Information

Personal Data may be collected through the following sources:

1. Direct submission by Users through BharatiyaGPT;
2. Customer support interactions;
3. Marketing and onboarding channels;
4. Publicly available sources where permitted by law;
5. Cookies and similar tracking technologies.

2.6 We may receive information when the user logs in to BharatiyaGPT and subscribes to the premium service via an authorized payment processor. Information will be collected.

2.7 Differential Treatment of Information Types

BharatiyaGPT provides differentiated treatment of the various types of information gathered through its operations based on the purpose intended for that information.

2.8 Handling of Sensitive Personal Data

BharatiyaGPT does not intentionally solicit or mandate the collection of Sensitive Personal Data or Special Category Personal Data as defined under applicable Indian law.

However, in the course of using the Platform, Users may voluntarily provide or upload information that may constitute sensitive personal data (including through prompts, documents, images, voice inputs, or other interaction features). In such cases, BharatiyaGPT shall process such data strictly in accordance with applicable law, this Privacy Policy, and only for the purpose of providing the requested Services.

Users are advised not to upload sensitive personal information unless strictly necessary. BharatiyaGPT shall not be responsible for sensitive personal data voluntarily disclosed by Users beyond the scope of the Platform’s intended usage.

2.9 Children and Minors

BharatiyaGPT Services are not intended for children below the age of 13 years. Users below 18 years shall use the Platform only under parental or guardian supervision. BharatiyaGPT does not knowingly collect Personal Data from minors without lawful consent.

3. PURPOSE FOR COLLECTING INFORMATION

Immverse AI will process information for appropriate business reasons to achieve BharatiyaGPT’s educational goals:

• To create and authenticate your account, including the verification of users and managing their accounts.
• For the provision and delivery of the Services, including AI-generated responses, knowledge discovery, and the functionality of apps.
• For sending administrative communications such as changes to the policies, features, or terms and conditions.
• For user-to-user communication, this function is available through the platform’s features.
• For obtaining feedback and performing research on how to enhance BharatiyaGPT’s quality and reliability.
• For sending marketing/promotional communications based on your preferences and opt-out rights.
• For personalising your content and optimising your experience, if applicable.
• For fraud prevention and ensuring the safety of our platform users, including the tracking of misuse.
• For producing usage analytics to identify usage trends to improve the Services we provide.
• For analysing campaign effectiveness to allow for responsible outreach.
• To protect your and other users’ vital interests, including safety and harm prevention.

4. INVENTORY, DISTRIBUTION, & EXCHANGE OF DATA

4.1 Where your info is stored

Your Data will primarily exist in an electronic format and mainly within Indian territory, subject to the terms of relevant laws to protect that data.

4.2 We Will Never Sell Your Info

We will never be able to sell, rent, or trade your data. Data will only be shared upon request to facilitate the commitments of providing the Services, and/or in order to comply with the Law.

4.3 Service Providers With Whom Info is Shared

Our trusted Partner Service Providers and Vendors may receive your DATA, but are allowed to receive DATA only as needed in order to provide BharatiyaGPT Services.

4.4 We Contract All 3rd Parties that Handle Your Data

All approved third-party vendors who will handle your DATA under contractual terms as outlined below:

• Will limit usage of your DATA to the reasons specified by BharatiyaGPT
• Will not disclose any DATA without specific approval.
• Will use reasonable means to protect the DATA they receive from you/our system.
• Will retain your DATA only for the time outlined in the Storage Policy.

4.5 Legal and Safety Disclosures

We may have to share information when it’s necessary. This can happen when the law says we have to or when something else requires us to disclose Information.

• Under applicable laws or regulations
• In response to lawful requests from authorities
• To protect BharatiyaGPT, Immverse AI, users, or the public
• To prevent fraud, misuse, or security threats
• To comply with legal processes or enforce rights

4.6 Merger or Acquisition

If Immverse Innovations Private Limited is involved in a change, such as a merger or sale, your Information will be transferred as part of that deal. This means your Information will still be protected. Immverse Innovations Private Limited will ensure that your Information is safe throughout this process.

4.7 Data Retention

BharatiyaGPT shall retain Personal Data only for such duration as is necessary to fulfil the purposes outlined in this Privacy Policy or as required under applicable law. De-identified and aggregated data may be retained for analytics, research, and service improvement purposes.

4.8 Data Security Measures

BharatiyaGPT uses industry-standard administrative, technical, and physical safeguards, including encryption, access control mechanisms, and secure server infrastructure to protect Personal Data. However, no system is completely secure, and BharatiyaGPT does not guarantee absolute security of transmitted or stored information.

5. User Content

5.1 Definition of "User Content."

“User Content” refers to any content, media, or information submitted by you using Services such as text, photos, videos, audio, generative media, conversations, messages, emails, feedback, suggestions, ideas, or the like. You are solely responsible for your User Content.

5.2 By transmitting or uploading any User Content while using Services, you grant Immverse AI a non-exclusive, worldwide, royalty-free, fully sublicenseable, perpetual, and irrevocable license to use, copy, display, reproduce, modify, distribute, store, and disclose the User Content solely for the purpose of providing and administering Services. If you are uploading another person’s content, you represent that you have obtained their consent and have the right to grant this license.

5.3 Cross-Border Processing Consent

User Content may be processed/stored on servers in India (primary) and transferred internationally (to the USA/Singapore for backups). You consent to such transfers essential for AI computation and redundancy.

Where Users are subject to foreign data protection laws, including GDPR or similar regulations, BharatiyaGPT shall implement appropriate contractual and technical safeguards consistent with such requirements to the extent applicable.

5.4 You represent and warrant that you have all necessary legal rights and permissions to upload or transmit User Content, and that it does not violate any law or infringe any intellectual property or privacy rights of any third party under Indian laws. If your User Content includes personal or sensitive information, you consent to its collection, use, disclosure, and transfer by Immverse AI as outlined in our Privacy Policy.

5.5 Immverse AI has no obligation to monitor, screen, police, edit, or remove any User Content. However, Immverse AI may review, monitor, restrict access to, or remove any User Content, in whole or in part, that Immverse AI considers objectionable, violates the Terms or applicable laws, or adversely affects the Services or other users. Immverse AI may also report any suspected illegal activity to appropriate law enforcement authorities.

5.6 User Content is owned by the contributing user. Immverse AI does not claim ownership of any User Content transmitted by you. You shall be solely liable for any Content you upload and for compliance with applicable laws. Any use of Services does not confer any proprietary interest or transfer any intellectual property rights to you apart from the licenses granted herein.

6. Generative Media

6.1 Nature of Generative Media

BharatiyaGPT provides a feature that helps users input prompts that may lead to the creation of Artificial Intelligence-generated content, such as text, pictures, sound bites, etc., commonly referred to as "Generative Media." The content generated by the Artificial Intelligence system does not contain any previously created information by humans.

6.2 License for Generative Media

By using these generative features, you give Immverse AI permission to use, reproduce, modify, store, and display these generative media worldwide, for any purpose, for an unlimited time, with no requirement for royalties, irrevocably, to permit others, and for all purposes, including for safety, compatibility.

6.3 Components Criados Dire

Within the domain of "Some Generative Media" itself, it is also feasible that certain features may derive from third-party data licenses or mechanisms. However, the rights to third-party elements will always belong to the third party.

6.4 User Responsibility

Use of Generative Media - Not always accurate or appropriate, it is entirely upto you to judge its appropriateness or inappropriateness.

We do NOT guarantee that any information in it is accurate or complete, or that it is fit for any particular purpose or use.

6.5 Feature Control

The people at Immverse AI can stop some features from working if they think it is not safe or if they have to follow some rules. They do not have to say sorry or pay for any problems this might cause to the Immverse AI.

7. Feedback

7.1 Feedback License

When you send in ideas like "Improve Ayurveda accuracy" or suggestions for the user interface, you are giving Immverse AI the right to use them forever without paying you or giving you credit. This means Immverse AI can do what they want with your ideas without having to say they came from you or give you any money.

7.2 No Confidential Information

When you give us your thoughts, do not send information that belongs to other people. Just because you stop using your account does not mean we no longer have the right to use your feedback. We can still use the feedback you gave us.

8. Third-Party Services

8.1 External Services

BharatiyaGPT may contain links or integrations to third-party platforms or services. These are provided for convenience and are not controlled or endorsed by Immverse AI.

8.2 No Liability

The interaction with you regarding Third-Party Services is entirely your responsibility. Loss, damage, or security issues are also handled by you. Immverse AI will not take any liability for this.

9. Ownership and Copyrights

9.1 Ownership of all software, models, interfaces, design elements, documentation, and proprietary technology used in or for BharatiyaGPT shall remain owned by Immverse Innovations Private Limited or its licensors.

9.2 All trademarks, logos, service marks, and related branding depicted on BharatiyaGPT are subject to applicable copyright and intellectual property laws and are not authorized for use without prior permission.

9.3 Immverse AI honors intellectual property rights and follows applicable copyright laws. Users may report copyright infringement, and appropriate actions will be taken in accordance with law.

10. Privacy Policy

10.1 Applicability of Privacy Policy

“Your access to and use of BharatiyaGPT is subject to the terms set out in the Privacy Policy of Immverse Innovations Private Limited, which is an integral part of the present Terms.” Hence, by using the facility of BharatiyaGPT, it implies that “you agree to the collection, storage, processing, sharing, and transfer of the information collected about/related to you, in the manner described in the Privacy Policy provided above.”

10.2 User Controls and Aggregated Data

There is a possibility of privacy and data control settings within BharatiyaGPT, which help you limit or restrict the collection of specific user data. However, it is important to note that opting out of specific data collection processes may affect the availability of specific features.

Furthermore, Immverse AI can continue to gather aggregate, anonymized, non-identifiable information on how its service is used, with no identifiability of you as a person.

10.3 Shared or Authorized Access

If you are using a public device to interact with BharatiyaGPT or allow other users to interact with your account, the details associated with your account will also be visible to other users, for which you must inform them appropriately according to the privacy norms.

11. Confidential

11.1 Confidential Information

You agree that you will not disclose any of Immverse AI’s “Confidential Information.” If you access any Immverse AI “Confidential Information,” you agree that you will not disclose any of it without first receiving prior written consent from Immverse AI.

“Confidential Information”

• Proprietary software, source codes, AI models, algorithms, and technical documents
• Non-public Business Plans and Strategies, Research Material, Business Development
• Unreleased features, prototypes, or internal tools related to BharatiyaGPT

11.2 Exceptions and Survival

Do confidentiality requirements apply to information that:

• Becomes publicly available without breach
• Is independently developed by you
• Is disclosed pursuant to a lawful requirement or court order
• These confidentiality obligations will apply even if your rights to use BharatiyaGPT terminate or expire.

12. Disclaimers

12.1 The BharatiyaGPT and all associated information, content, responses, data, and features are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

12.2 No Warranties

Immverse AI expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to:

• Accuracy, Completeness, Reliability, or Quality of Artificial Intelligence Machine Content
• Fitness for a particular purpose or merchantability
• Continuous, uninterrupted, secure, or error-free operation
• Non-infringement of third-party rights

12.3 Immverse AI cannot guarantee Services will meet your expectations, be timely, secure, or error-free. We do not endorse opinions, information, statements, or material displayed or distributed through Services. You shall bear any risks associated with your access and use of Services.

13. Liability Limitation

13.1 UNDER NO CIRCUMSTANCES WILL IMMVERSE AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, OR LICENSE BE LIABLE TO YOU FOR ANY LOSS OF PROFITS OR REVENUE, LOSS OF BUSINESS, LOSS OF GOODWILL, LOSS OF DATA, BUSINESS INTERRUPTION, OR INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF SERVICES OR INABILITY TO ACCESS OR USE SERVICES, EVEN IF ADVISED IN ADVANCE OF SUCH POSSIBILITY AND IRRESPECTIVE OF WHETHER SUCH DAMAGES ARE FORESEEABLE OR WHETHER IMMVERSE AI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES IN ADVANCE.

13.2 WITHOUT LIMITING THE FOREGOING, IN NO EVENT WILL IMMVERSE AI’S AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS UNDER THESE TERMS EXCEED INR 1000 (INDIAN RUPEES ONE THOUSAND). THE EXISTENCE OF ONE OR MORE CLAIMS SHALL NOT INCREASE THIS MAXIMUM LIABILITY AMOUNT.

13.3 THE ABOVE LIMITATIONS SHALL APPLY REGARDLESS OF THE FORM OR THEORY OF ACTION AND SHALL APPLY TO THE GREATEST EXTENT PERMITTED UNDER APPLICABLE LAW, EVEN IF CERTAIN REMEDIES FAIL. SOME JURISDICTIONS MAY NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE PROVISIONS MAY NOT FULLY APPLY.

14. Indemnity

14.1 You agree to indemnify, defend, and hold harmless Immverse AI and BharatiyaGPT, including our respective officers, directors, employees, partners, agents, and contractors, for any claims, damages, liabilities, losses, penalties, or expenses, including our respective legal fees, related to:

1. Your utilization or abuse of the application and services of BharatiyaGPT;
2. Any information or content you input via BharatiyaGPT;
3. Any violations of these Terms or the Privacy Policy; or
4. Infringement of any third-party rights

14.2 Immverse AI reserves all rights to take over completely the defense of any claim that is within the scope of an indemnity hereunder, at your own expense.

15. Governing Law and Jurisdiction

15.1 The interpretation of these Terms, including the BharatiyaGPT Privacy Policy, will be governed by the laws of India, excluding any conflict of laws rules.

15.2 All disputes arising out of and in relation to BharatiyaGPT and these Terms shall be subject to the exclusive jurisdiction of courts located at Nagpur, Maharashtra, India, and you consent to such jurisdiction accordingly.

16. Termination

16.1 Access to services provided by Immverse AI through the use of the BharatiyaGPT tool can, without notice, be terminated or limited, the reasons being, but not limited to, misuse, violation of policy, inactivity, and legal requirements, etc.

16.2 Within your right of access, your right to access BharatiyaGPT shall immediately cease on termination. Further, we shall have the right to delete or deactivate your account in accordance with our data retention policies.

16.3 The provisions regarding confidentiality, disclaimers, limitation of liability, and indemnity shall continue even after termination.

17. Modifications to Policy and Terms

17.1 Immverse AI reserves the right to vary, modify, or amend these Terms or BharatiyaGPT’s Privacy Policy from time to time for any reason whatsoever by making additions, deletions, or alterations to these Terms or BharatiyaGPT.

17.2 The continued and future use of BharatiyaGPT after any changes to the Terms constitutes a user’s acknowledgement and acceptance of the resulting changes to the Terms. It is recommended that this policy be reviewed from time to time. In the event a user does not agree to any changes made to the Terms, they must stop using the Services altogether.

17.3 Cookies and Tracking Technologies

BharatiyaGPT uses cookies and similar technologies to improve platform functionality and user experience. Users may disable cookies through browser or device settings; however, certain features of BharatiyaGPT may not function optimally if cookies are disabled.

17.4 Grievance Redressal Officer

In accordance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023, BharatiyaGPT hereby appoints the following Grievance Redressal Officer:

All user grievances shall be acknowledged within forty-eight (48) hours and resolved within seven (7) working days.

18. General Provisions

18.1 Severability

If any provision of this Policy is held to be invalid or unenforceable, the remaining provisions of the Policy shall remain fully effective.

18.2 Assignment

The User shall not be able to cede its rights granted thereunder without our written consent. Such a right shall be freely assignable by us to others as a part of its legitimate activities.

18.3 Non-Waiver

If Immverse AI does not observe any of these provisions, such a failure shall in no way be considered a waiver of such provisions.

18.4 Relationship

No partnership, agency, or joint venture will exist between the user and Immverse AI by utilizing the service of BharatiyaGPT.

18.5 Notices

Any official communication may be sent through in-app messages, registered email, or announcements on Immverse AI/BharatiyaGPT platforms, which would be considered received within 24 hours.

18.6 Entire Agreement

The Terms, in addition to the Privacy Policy and other policies, shall be treated as an agreement in its entirety with respect to BharatiyaGPT's usage.

18.7 Confidentiality

Any information considered confidential, including dispute resolution outcomes and platform information, will remain confidential, except where legally required to disclose the information.

18.8 Severance

Any invalid provision shall be construed in a way that most closely resembles the original intention, but which does not impair the enforceability of the remaining Terms.

18.9 Section

Users accessing BharatiyaGPT are responsible for compliance with applicable local, national, and international laws. Access is prohibited where use of such services is unlawful.

20. Agreement to Arbitrate

You agree that any dispute, controversy, or claim arising out of or relating to these Terms, the Website, the Services, any transaction, interaction, or legal relationship between you and Immverse Innovations Private Limited (including any alleged breach thereof) shall be resolved exclusively by final and binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 and amendments thereto. By accepting these Terms, both parties expressly waive the right to initiate or participate in any civil suit, trial by jury, or class action proceedings, except as expressly permitted under applicable law.

Seat and Venue of Arbitration

The seat and legal place of arbitration shall be Nagpur, Maharashtra, India. The arbitration proceedings may be conducted physically or through virtual/online mode at the discretion of Immverse Innovations Private Limited.

Governing Law

This Arbitration Agreement shall be governed by and construed in accordance with the laws of India.

Appointment of Arbitrator

The arbitration shall be conducted by a sole arbitrator appointed by Immverse AI. In the event of disagreement regarding appointment, the arbitrator shall be appointed in accordance with Section 11 of the Arbitration and Conciliation Act, 1996.

Language of Proceedings

The arbitration proceedings shall be conducted in the English language.

Costs and Fees

Each party shall bear its own legal costs. The arbitrator’s fees and arbitration administrative expenses shall be borne as determined by the arbitrator in the final award.

Prohibition of Class and Representative Actions

You and Immverse Innovations Private Limited agree that claims may be brought only on an individual basis. The arbitrator shall not have authority to consolidate claims, conduct class arbitration, or preside over representative proceedings.

Relief Limitation

The arbitrator may grant relief only to the extent necessary to resolve the individual dispute and shall not award relief affecting any third party or unrelated users.

Pre-Arbitration Dispute Resolution

Before initiating arbitration, the aggrieved party shall send a written Notice of Dispute by registered post or email describing the nature of the dispute and the relief sought.

If the dispute is not resolved within sixty (60) calendar days of receipt of such Notice, either party may initiate arbitration proceedings.

Interim and Injunctive Relief

Nothing in this clause shall prevent Immverse Innovations Private Limited from approaching courts of competent jurisdiction for interim relief, injunctive protection, intellectual property enforcement, data protection remedies, or urgent preventive relief.

Confidentiality of Proceedings

All arbitration proceedings, submissions, evidence, and awards shall be treated as confidential unless disclosure is required by law or regulatory authorities.
